Same Sex Issues

On June 26, 2015 the Supreme Court of the United States ruled same-sex marriage constitutional nationwide. In doing so, it opined: "No union is more profound than marriage, for it embodies the highest ideals of love, fidelity, devotion, sacrifice and family. In forming a marital union, two people become something greater than they once were."   This means that all couples, regardless of sexual orientation, can enjoy the benefits that come with legal marriage.

For long-term same sex couples, a prenuptial agreement regarding property or children may be something to consider before you tie the knot. In Michigan, marital property is considered anything that was acquired during the course of the marriage.  For same-sex couples that have acquired property prior to marriage, a prenuptial agreement which identifies property to include (rather than exclude) in the marital estate may be something to consider.  Additionally, joint estate plans and step-parent adoptions may be actions you wish to take after you say "I do".
